That's y most dev companies have a PR team of some kind cause they have some copy paste stuff they always say to everyone when they are negative. There is so many reasons not to engage with your customers one on one most times I have learned that it's best not to talk to most folks it sucks but it's how it is. And yes that makes them a DERIVATIVE WORK and subject to the earlier copyright. And yes I am a Lawyer. However a court could find the work sufficently transformative to fall under fair use.
