TLDR: using -NC picture in an open source project can be considered commercial use, even if you haven't got any money from it.

A government owned radio channel (no advertisements, runs at a loss and is meant for public good) used a CC-by-NC picture with full attribution and everything on their freely accessible website and was sued by the photographer because of "commercial use". In the 1st instance this was ruled as correct as according to the judge "NC" means purely "private" use!

So especially if you are in Germany avoid the "NC" option like the bubonic plague!

While I agree that photographers are useless I think that the most toxic people are the so called game artists and modders.

``put author somewhere'' is the only good license. GPL-esque ones I can tolerate as well.

CC-by-NC and all these other ``don't use it for $VAGUE_THING'' licenses are aids. Especially the hilarious ones where $VAGUE_THING is ``using the software for evil''
