"I feel the main culprit here is (as usual) the GPL.

The idea of open sourcing is that of giving people full freedom on your stuff. BSD like license is the real spirit of open source.

Then the GPL license then comes around, to prevent people from using your free software in non-free software.
Though some may argue it's a good idea, I profoundly dislike it.
If you want to make money sell your code, if you want to give for the spirit of giving and freedom make your code BSD, but don't give me a bloated, confusing license that is free but at the same time restricts my freedom and ultimately ends up causing more trouble than it solves.

GPL since Carmack is being used to "open source" stuff without losing the possibility for economic exploitation, with the trick of not including assets etc.

This is again a bad idea imo, and more a publicity stunt than something really helpful. Also there are also dodgy ways people with ill intentions can use to get around those like re-skinning etc.

So yeah my idea is, if it's commercial keep it closed source, if it's free keep it BSD, mixing up commercial+open source with the GPL ends up just being messy."

Besides shame, there are no other way to force the government to respect any license. Government can easily imprison and execute anyone, the only thing that stops government from doing that are societal morals.
